Terms and Conditions1. Hosting and web/email forwarding is provided on a best endeavours basis. 99% or better uptime but there may be occasions when the extra features of the servers are unavailable if continued use of the features (such as logging and CGI-BIN) pose a security risk on one or more accounts and have to be disabled until security patches can be implemented. 2. Payment for hosting, forwarding or parking services for a domain name is due within 7 days of production of an invoice for the services. Failure to pay on time may result in the domain being suspended. For .uk domains, the right is reserved to detag the Domain. Domain names will not be purchased or renewed until full payment is received. In the event of an outstanding dispute, the domain, in whatever jurisdiction, will be locked until the issue is resolved. 3. Although there is no charge for releasing a domain, Signpost Web Design reserves the right to refuse release in the case where an invoice for services is outstanding. See (2) above. 4. You may not use the account for (i) Sending unsolicited email, commercial or otherwise, whether in bulk or to specific individuals. You may not send unsolicited posts to newsgroups to advertise your web site or services except where such posts are expressly permitted . Unsolicited email or newsgroup posts are often known as "spamming". (ii) Use the account to break into, or use the services of, any computers that you have no permission to access. This includes attempted hacking of servers, distribution of Trojan programs or their use on other computers; attempts at mail or news relaying; attempting to subvert form to email scripts; knowingly distribute viruses. (iii) Deliberately cause inconvenience to other members of the Internet by mailbombing, Denial of Service attacks, forgery of other email addresses or deliberate harassment. (iv) Display copyrighted information where you do not either own the Copyright or have permission to use the copyrighted material. (v) Promote, endorse or provide links to the promotion of activities which are illegal within the United Kingdom. This includes Ponzi schemes, Warez and all and any scams. (vi) Sites of a pornographic nature. Signpost Web Design, in conjunction with the owners of the Servers, reserve the right to cancel or suspend all or any part of the accounts of any account holder, or their affiliates, who breach these terms. The list of potential Internet Abuse activities above is not exhaustive. If you are in any doubt as to whether a certain activity may or may not breach the terms and conditions then please do talk to us first. We do NOT take any action against customers for asking advice on whether or not a particular course of action is legal or would breach the terms and conditions of the account. 5. Payment for services is for one year in the case of the international domains and all hosting services. For .uk domains, the domain fee covers two years. Moving to another provider will not normally result in a refund for the period of time that remains on a hosting account. There are no refunds for domain names. 6. If you wish to move your account to another provider at the time of your renewal of hosting or domain name, you must give at least 4 weeks notice of your intention to do so. 7. Where abuse of the Internet by the customer is reported to Signpost Web Design and found to be actionable after an investigation, all necessary and appropriate actions in the specific circumstances will be taken. These actions may include suspension of all or part of the services until suitable undertakings have been received or cancellation of the account. 8. Unless the client can show that they have an effective Department that can trace correctly and act upon reports of abuse of the Internet using the domain, then abuse@yourdomain will be directed to Signpost Web Design. This is for the protection of clients. A few abuse reports are malicious and many are completely unfounded due to the number of viruses today that can forge From: headers on a compromised machine other than your own machine(s). In all cases, there is the expertise at Signpost Web Design to determine the real sender of messages or where it was relayed through and ask the relevant ISP Abuse Department to investigate on your behalf. Your account will NOT be terminated or have conditions imposed upon it in the event of malicious reports or virus attacks unless the virus was propagated by your own machines when any email service will be suspended until your machines have been disinfected to our satisfaction. 9. Customers of Signpost Web Design who are found to have made malicious abuse reports, as reported by an ISP/Hosting Abuse Department, may have all or part of their service suspended pending the receipt of suitable undertakings in writing or may have their account cancelled. 10. Technical, Billing and Admin contacts for domains cannot be changed outwith Signpost Web Design, or if appropriate, Design Web as my supplier. This is required to ensure the smooth running of your domain. Changes to the Registrant contact information should be submitted to the email address domains@signpost-design.co.uk 11. This agreement is to be governed by English Law and, if any part is found to be unenforceable, then the remaining provisions will remain in force. Complaints about a customerAll complaints about customers of Signpost Web Design should be addressed to abuse@signpost-design.co.uk with the full and complete headers and body of offending email or newsgroup posts. After investigation, appropriate action will be taken when and where necessary. You may or may not receive further communication after the autoresponse to an abuse complaint as the Data Protection Act and other laws may preclude a response. Malicious complaints and any complaints that are abusive in nature themselves will be referred to the ISP of the originating email - our zero tolerance policy towards Internet Abuse extends not only to our customers but all communications received by Signpost Web Design in this respect. Rest assured that any customers of Signpost Web Design who transgress our policies will be dealt with severely. If you are complaining about a customer of ours, then we do need to have all the information available to you - this means that for newsgroup posts and emails we do need to see the complete headers and body of the newsgroup article/email. Without the full information we may not be able to take action and please see Section 8 above
